On March 15, 2023, the U.S. Copyright Office announced that works created with the assistance of artificial intelligence (AI) may be copyrightable, provided the work involves sufficient human authorship. Copyright Registration Guidance: Works Containing Material Generated by Artificial Intelligence, 88 Fed. Reg. 16,190 (Mar. 16, 2023) (to be codified at 37 C.F.R. § 202).

This is the Copyright Office’s first-ever formal guidance on this issue.

It is well established that only material that is the product of human creativity is eligible for copyright registration under U.S. law. In the Federal Register Notice, the Copyright Office explained that the scope of this “human authorship requirement” has been challenged in recent years with the onset of AI-generated works, and that the Copyright Office already has received and examined multiple applications for registration that claim copyright in AI-generated material.

According to the policy statement, works created by AI without human intervention or involvement still cannot be copyrighted, as they fail to meet the human authorship requirement. For example, when an AI program produces a complex written, visual, or musical work in response to a prompt from a human, the “traditional elements of authorship” are determined and executed by the technology—not the human user—and, thus, the resulting work is not copyrightable. On the other hand, a work containing AI-generated material may be copyrightable where there is sufficient human authorship, such as when a human selects or arranges AI-generated material in a creative way or modifies material originally generated by AI technology. Ultimately, copyright protection will depend on whether the AI’s contributions are “the result of mechanical reproduction,” or they reflect the author’s “own mental conception,” the Copyright Office said. “The answer will depend on the circumstances, particularly how the AI tool operates and how it was used to create the final work.”

Copyright applicants must disclose when their work includes AI-generated material, according to the Notice, and previously filed applications that do not disclose the use of AI must be corrected.

The Copyright Office stated that it may issue additional guidance in the future related to the registration of works produced by, and other copyright issues presented by, this technology and intends to publish a notice of inquiry later this year seeking public input on additional legal and policy topics involving AI. These steps indicate the Copyright Office’s intent to remain involved in the evolving legal landscape of AI technology and its implications for copyright law.

A Surprising Speed Test

My Internet Just Got a Whole Lot Faster

As someone who’s been using BSNL Fibre broadband for a while now, I’ve grown accustomed to managing with download speeds of around 50 Mbps—despite the company promising speeds of up to 100 Mbps. It’s not that I had low expectations, but after months of the same results, I had made peace with the fact that I’d never see anything close to that advertised speed.

But today, something completely unexpected happened.

The Routine Speed Test: Breaking the 50 Mbps Barrier

Like most of us, I occasionally run a quick speed test to see if my internet is performing up to par. It had become a bit of a routine—open the speed test website, watch the needle hover around 45 to 50 Mbps, and move on with my day. Today, I wasn’t expecting anything different.

Imagine my surprise when the result came back: 101.7 Mbps download speed. I did a double-take. Was my connection finally living up to the 100 Mbps promised by BSNL? Could this really be happening?

Unpacking the Speed Surge

For months, my experience had been consistently below the advertised speed, and honestly, I had learned to live with it. Streaming, video conferencing, and everyday browsing worked fine for the most part. But this jump to over 100 Mbps was new territory for me.

Not only did the download speed exceed my expectations, but the upload speed came in at 59.6 Mbps—another number far higher than my usual results. To top it off, latency was a mere 26 ms, and the server I was connected to was based in Chennai. The test result even went as far as to inform me that my connection could handle multiple devices streaming HD videos, video conferencing, and gaming all at once. It was a far cry from the performance I had grown used to.

A Glimpse into Optimism: Is This the New Normal?

It got me thinking: was this just a temporary glitch or a sign of things finally improving? Had BSNL silently made improvements to the fibre network in my area, or was this just an exceptionally good day for my connection?

I don’t know if this speed boost will stick around, but it has certainly made me more optimistic. With over 100 Mbps at my fingertips, the possibilities seem endless. The idea of uninterrupted video conferences, blazing-fast downloads, and smooth streaming feels more tangible than ever.

A Word of Advice: Always Check In

If there’s anything this experience has taught me, it’s that you should never stop checking in on your internet performance. Even when you’ve settled into a routine of accepting less-than-stellar speeds, things can change when you least expect them. Today, I’m proof of that.

Maybe tomorrow the speed will dip again, or maybe this is the new normal. Either way, I’m glad I ran that speed test today. It reminded me that sometimes, even when you least expect it, things can exceed your expectations.
